Terms and Conditions

Please read these Terms and Conditions (“Terms”) carefully before using the CheckTwin iOS application or website (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By downloading, installing, or using CheckTwin, or by accessing the CheckTwin website, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you must not use the Service.
You must be at least 16 years old to use CheckTwin. By using the Service, you confirm that you meet this requirement.
2. About CheckTwin
CheckTwin is an iOS application developed and operated by Albert Sola-Faba (sole trader). The app allows users to document property inspections by capturing photos, annotating images, recording condition ratings, and generating PDF inspection reports.
CheckTwin is designed as a documentation and record-keeping tool for landlords, letting agents, property managers, and related professionals.
3. Age Requirement
You must be 16 years of age or older to use CheckTwin. By using the Service, you represent and warrant that you are at least 16 years old. If you are under 16, you must not use the Service.
4. Licence to Use
Subject to your compliance with these Terms, Albert Sola-Faba grants you a personal, non-exclusive, non-transferable, revocable licence to download and use the CheckTwin app on devices you own or control, solely for lawful property inspection and management purposes.
You may not:
- Copy, modify, distribute, sell, or sublicence the app or any part of it
- Reverse engineer, decompile, or disassemble the app
- Use the app for any purpose other than its intended property inspection and documentation function
- Remove or alter any proprietary notices or labels
5. User Responsibilities
When using CheckTwin, you are responsible for:
- Entering accurate, complete, and truthful information
- Maintaining the security of your device and any backups of your inspection data
- Complying with all applicable laws, including landlord and tenant legislation and data protection laws, in your use of the Service
- Obtaining any necessary consents before photographing individuals or third-party property
- Not using the Service for any unlawful, fraudulent, or harmful purpose
6. Inspection Reports — Important Disclaimer
Please read this section carefully.
Reports generated by CheckTwin are provided for record-keeping and documentation purposes only.
- CheckTwin reports are not professional legal opinions, surveyor reports, chartered condition assessments, or expert evidence.
- CheckTwin does not independently verify any information, photographs, or assessments entered by users.
- You are solely responsible for the accuracy, completeness, and integrity of all data you enter into the app.
- The evidential weight of a CheckTwin report in deposit disputes, court proceedings, or other legal contexts is determined by the relevant third party (e.g., a tenancy deposit scheme, tribunal, or court) and is not guaranteed by CheckTwin.
- CheckTwin makes no representation that its reports will be accepted as evidence in any legal or regulatory proceeding.
- Where legal, professional, or expert advice is required — including in connection with deposit disputes, property condition disputes, or compliance matters — you should seek independent qualified advice.

7. Intellectual Property
All intellectual property rights in the CheckTwin app, branding, PDF report templates, and associated materials are owned by Albert Sola-Faba / CheckTwin.
Your content: Inspection data, photographs, notes, and other content you create using the app remain your property. You grant CheckTwin no intellectual property licence beyond what is strictly necessary to provide the Service to you (for example, rendering your photos in a PDF report).
Nothing in these Terms transfers ownership of any intellectual property to you.
8. Data & Backups
Current state: All inspection data is stored locally on your device. You are solely responsible for maintaining backups and preventing data loss.
Future cloud sync: When cloud sync functionality is introduced, it will be governed by additional terms and our Privacy Policy. Details will be provided before that feature is made available.
CheckTwin is not liable for any loss of data resulting from:
- Device failure, loss, theft, or damage
- Deletion of the app
- User error
- iOS updates or system changes
We strongly recommend maintaining regular device backups via iCloud or iTunes/Finder.
9. Pricing & In-App Purchases
CheckTwin is currently free to use. We may introduce paid features or subscription tiers in the future.
- Any charges will be clearly disclosed to you before purchase.
- In-app purchases are processed by Apple through the App Store and are subject to Apple’s terms and conditions.
- Refunds for in-app purchases are handled in accordance with Apple’s App Store refund policy and your rights under the Consumer Rights Act 2015.
We will update these Terms before introducing any paid features.
10. Availability & Updates
The Service is provided on an “as is” and “as available” basis.
- We do not guarantee uninterrupted or error-free availability of the Service.
- We may update, modify, or discontinue features of the Service at any time. Where practicable, we will give reasonable advance notice of significant changes.
- We may release updates to the app via the App Store. Some updates may be required to continue using the Service.
11. Limitation of Liability
To the maximum extent permitted by Scots law and applicable UK consumer protection legislation:
- CheckTwin’s total aggregate liability to you in connection with the Service shall not exceed the greater of: (a) the total amounts paid by you for the Service in the 12 months preceding the claim, or (b) £100.
- CheckTwin shall not be liable for any indirect, consequential, incidental, special, or punitive damages, howsoever arising.
- CheckTwin shall not be liable for loss of data, loss of profits, loss of revenue, loss of business, or damage to property arising from your use of the Service.
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Any liability that cannot be excluded or limited under the Consumer Rights Act 2015 or other applicable UK law
12. Third-Party Services
CheckTwin integrates with third-party services including Apple Maps and the iOS Share Sheet. These services are provided by third parties and are subject to their own terms and privacy policies. CheckTwin is not responsible for:
- The availability, accuracy, or content of third-party services
- Any loss or damage arising from your use of third-party services
13. Prohibited Use
You must not use CheckTwin to:
- Engage in any unlawful, fraudulent, or harmful activity
- Harass, intimidate, or harm any person
- Scrape, extract, or systematically collect data from the app
- Attempt to gain unauthorised access to any system or network
- Reverse engineer, decompile, or copy any part of the app
- Distribute malware or any harmful code
- Infringe the intellectual property rights of any third party
We reserve the right to terminate your access to the Service if you breach any of these prohibitions.
14. Termination
- By you: You may stop using CheckTwin at any time by deleting the app from your device.
- By us: We may suspend or terminate your access to the Service immediately and without notice if you breach these Terms or if we are required to do so by law.
Upon termination, your licence to use the app ends. Provisions that by their nature should survive termination (including Sections 6, 7, 11, and 16) shall continue to apply.
15. Changes to These Terms
We may update these Terms from time to time. Changes will be communicated via an in-app notice and/or on the CheckTwin website. The effective date at the top of this page will reflect the most recent version. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
16. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with Scots law. Any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the Scottish courts.
